WARRANTY

(B)STRONG LIMITED WARRANTY POLICY

Your (B)STRONG SystemTM consisting of genuine (B)STRONG hardware products (belts, pump and case) (“Hardware”) and genuine software products (“Software”) are covered by the following Warranty policy (the “Limited Warranty”). Genuine (B)STRONG products must be purchased directly from Stray Whales, LLC or an authorized Re-seller to be covered under this Limited Warranty


Money Back Guarantee. If and when B Strong advertises a money back guarantee, the terms of this guarantee cover a return for refund request within 30 days from the date of purchase. In order to be eligible for the return for refund, the product must be in like new condition, free of cosmetic defects or signs or wear and tear. The customer will cover the cost of shipping the product back to B Strong and will not be refunded the original shipping fee if one applied to the original order. Limited Warranty provisions herein shall not apply to resale or other distribution other than to the original purchaser, unless through an authorized distributor, in which case the distribution contract will dictate distributor warranty and pass-through provisions.


This Limited Warranty applies to products intended solely for personal, family, or household purposes. The terms of this Limited Warranty provide the exclusive and sole remedy available to (B)STRONG customers and the Limited Warranty is limited as follows:


HARDWARE WARRANTY

(B)STRONG warrants to Owner that the (B)STRONG Hardware shall be free from manufacturing and materials defects for a period of one (1) year from original date of purchase (the “Warranty Period”).


ALL OTHER WARRANTIES, INCLUDING WITHOUT LIMITATION ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY, WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, WARRANTY OF A PARTICULAR RESULT, OR ANY WARRANTIES ALLEGED TO ARISE FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE ARE HEREBY EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.


REPLACEMENT AND REPAIRS

Upon receipt of returned defective product, (B)STRONG will, at (B)STRONG’s sole discretion and expense (except with respect to return shipping as discussed below), repair defects, replace product, or refund the purchase price excluding applicable shipping and tax charges that can’t be recouped by (B)STRONG, during the Warranty Period.


Repairs shall not extend the Warranty Period beyond the original Warranty Period as determined from the purchase date of the product.


As with any garment, (B)STRONG wearable components are expected to endure a reasonable degree of wear and tear and cosmetic looks will change over time. Cosmetic appearance shall NOT constitute a valid reason for return or request of replacement product aside from a cosmetic defect out of the box. Further, defects which do not materially impact the function, such as a fraying edge of fabric, or broken stitch, of the (B)STRONG System also shall NOT constitute a valid reason for return or request of replacement product. Customers are expected to treat (B)STRONG equipment with care, and NOT put undue stress or strain on the stitching, pull tabs, throw the case and hand pump around, or otherwise put the components into stressful situations for which they were not designed. (B)STRONG is happy to answer questions about what is and isn’t acceptable if not clearly stated in the User Manual.


LIMITATIONS ON HARDWARE WARRANTY COVERAGE

This limited warranty does not cover any damage, impairment or problems which result from accident, neglect, modification, abuse or misuse of the product or use other than in accordance with the (B)STRONG Software or User’s Manual including, but not limited to: improper washing and drying techniques, build-up of mildew, exposure to unsuitable environmental conditions (including, but not limited to, changes in heat, humidity, or moisture, including water saturation), impact damage, normal wear and tear, indentations, scratches or surface damage (including abrasions caused by failure to use, protect or maintain the product properly), product deterioration or variations in color or marking that are ordinarily expected based on ordinary use or develop over time because of natural processes such as exposure to sunlight, and damage caused to products during shipping.


(B)STRONG Hardware and Software are designed for personal, family or household use only (2 times per day maximum), and repeated use throughout the day may cause component failure earlier than expected. (B)STRONG equipment subject to commercial use in this regard is NOT covered under this Limited Warranty, and excessive use in commercial applications shall void the Limited Warranty herein.


PROHIBITION ON PRODUCT MODIFICATIONS

Any customer modification of the (B)STRONG System components is strictly prohibited and use with accessories, software, or equipment not provided by (B)STRONG immediately voids the Limited Warranty provided herein.


SHIPPING COSTS, RESPONSIBILITY, AND TIMING

Limited Warranty return shipping charges are the responsibility of the customer. The customer will be responsible for, and pre-pay, all return shipping charges and shall assume all risk of loss or damage to product while in transit back to (B)STRONG. We recommend that the customer use a traceable method of shipping for protection. (B)STRONG will cover the outbound shipping back to the customer with the standard ground shipment option. Return shipping times are subject to then-current shipping conditions for delivery times.


SOFTWARE LIMITED WARRANTY

(B)STRONG warrants that Software will be supported and in service for at minimum, the duration of the Warranty Period.


ALL OTHER WARRANTIES, INCLUDING WITHOUT LIMITATION ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY, WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, WARRANTY OF A PARTICULAR RESULT, OR ANY WARRANTIES ALLEGED TO ARISE FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE ARE HEREBY EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.


(B)STRONG will endeavor to keep Software applications current with new versions of operating systems (for example iOS and Android) and support a reasonable history of older OS versions, and will maintain a list of supported OS’s and respective versions available upon customer request, but a failure to do so shall not be considered a breach of the Limited Warranty provided herein. (B)STRONG requires the customer to check that their mobile device is compatible with (B)STRONG’s Software prior to purchase, or be required to also obtain appropriate hardware to utilize the Software.


FURTHER LIMITATIONS ON WARRANTY

This limited warranty does not cover, and (B)STRONG hereby expressly disclaims any warranty that the use of the (B)STRONG System is fit for any particular purpose, that use of the (B)STRONG System will result in any improved performance on the Customer’s part, or that the (B)STRONG System will produce accurate results or any specific information.


The (B)STRONG System has not been developed specifically for any Customer and is not intended or designed to meet any particular Customer’s specific requirements or specifications.


The (B)STRONG System should not be used as a basis for medical diagnosis. Customer acknowledges that the Service is a reporting and analytical tool only and (B)STRONG will not be responsible for any training decision made by the Customer including the consequences of any training decision such as injury to the Customer which shall be the sole decision and responsibility of the Customer.


(B)STRONG Software is designed to assist you in achieving safe and effective use of the (B)STRONG System. The Software will help instruct the Customer on how to achieve results, but does not guarantee them. (B)STRONG does not guarantee that the Customer will see results in any particular timeframe, as many factors aside from the Customer’s (B)STRONG training influence improvements in strength and fitness such as: proper technique, consistency, sleep, and nutrition.


LIMITATIONS ON DAMAGES

To the fullest extent permitted by applicable laws, (B)STRONG hereby excludes and disclaims liability for any indirect, general, special, punitive, lost opportunity, incidental or consequential damages or losses, loss of use, loss of data, loss of income or profit, claims of third parties, or loss of or damage to property arising out of or in connection with the use, functionality, or defects in the Hardware, Software or of any part of the (B)STRONG System, the (B)STRONG website or any other site linked thereto, even if (B)STRONG has been advised of the possibility of such damages or losses.


REFUNDS AND RETURNS CONDITIONS

Because our Hardware products are wearable garments, for sanitation purposes, all products must be un-used, unwashed, unworn, and in their original condition to be eligible for a refund. If eligible, refund requests must be initiated within 15 days or receipt of goods. Refunds will typically be processed within 30 business days from receipt of goods from the customer, and refund amounts do not apply to shipping charges or taxes. Refund requests made on purchase through a third party must be directed to the third party and will not be fulfilled by (B)STRONG.


If you are concerned with sizing, kindly notify us ahead of using the product and we can discuss with you to address any concerns or change an order. Once products are used, we do not accept a return or replacement, other than for manufacturing defects. Products, if satisfying the un-used, un-worn, un-washed, condition, may only be returned for a refund for a reason other than sizing. If sizing was the cause for return, only a replacement for a different size is possible and clients will be asked to pay the re-shipping fee.


(B)STRONG KNOWLEDGE, DVDs, LITERATURE, Software and other knowledge related items are not eligible for any return, repair, or modification.


CUSTOMER SERVICE GUIDELINES

(B)STRONG highly values customer support and service. Support requests are submitted to [email protected] and email is the initial and primary form for all support and Limited Warranty requests.


Once we receive a service request via our website, phone, or email, we will follow up with the Customer with the goal to resolve the issue as quickly as possible. Typical response time is within 48hrs, but can vary depending on region and time-zone, and when the request was actually received. For issues outside of the United States, we will correspond by email with our support staff.
